Please use the booking confirmation invoice email as proof of payment and confirmation of your reservation with VELAYAT.

Agreement Terms
This Agreement (the "Agreement") is a legally binding contract entered into on the Reservation Date between the undersigned guest and VELAYAT. By signing, the Guest agrees to rent the residence as specified on the booking platform for the duration of the Rental Term, in exchange for the Total Rental Fee and other valuable considerations outlined herein.

1. Booking and Payment Procedure

Full payment is required in advance of your stay and will be processed on the day of booking. We will keep your credit card details on file to cover any potential damages or additional costs. Once payment is received, you will receive written confirmation of your booking. You may request to extend your stay at any time, subject to availability, with no extra fees for last-minute bookings.

Payments must be made in full and in advance via bank transfer or credit/debit card. All prices are quoted in UK Pounds Sterling and are accurate at the time of publication. Please note that bookings made with a credit/debit card must be done by the cardholder or with their consent. Guests must be at least 18 years old to book with VELAYAT.

For bookings of 4 weeks or less, full payment is required at the time of booking (prior to occupancy).

For stays longer than 4 weeks, payments are invoiced in 4-week blocks (30 nights). The initial 4 weeks' payment is due at the time of booking, with subsequent payments required at least every 2 weeks before the next period begins. Further payments will need to be made every 28 days. Failure to pay for booked dates may result in a holding deposit being taken.

2. Holding Deposit

We reserve the right to charge a holding deposit of £250 for any booking, at our discretion. This deposit is processed via credit or debit card and will be refunded once the keys are returned and the property has been inspected for damages. Refunds will be processed within 5 to 10 days after check-out day.

3. Cancellation Policy

If a guest cancels at any time, they will be charged the total price of the reservation. For stays longer than 28 days, guests can cancel up to 60 nights in advance; however, if cancellation occurs after this period, they will be charged 100% of the reserved dates. No refunds will be issued for no-shows. Depending on the circumstances of your cancellation, you may be able to recover cancellation fees through your travel insurance, so we strongly recommend purchasing adequate coverage. Please note that any reduction in the length of your stay will be treated as a cancellation.

If We Cancel Your Booking:
In exceptional circumstances, VELAYAT may need to cancel a booking. In such cases, we will make all reasonable efforts to provide a suitable alternative from our property portfolio.

3.1 Check-In and Check-Out Times:
Guests may check in to their accommodation after 4 PM (unless otherwise specified) on the start date of their booking. Unless otherwise agreed, check-out must be completed by 10 AM on the last day. If you fail to arrive by 8 PM on the start date without notifying us of a late arrival, we may consider your booking cancelled.

4. Amendments to Bookings

If a guest wishes to amend their booking (including changes to dates, accommodation, or check-in/out times), we will make every reasonable effort to accommodate the request. However, the guest will be responsible for any additional charges that may apply. Please note that if amendments are requested after the stay has begun, we may not be able to fulfils those requests.

Should a guest decide to vacate the apartment early and terminate the remainder of their stay, this must be confirmed in writing, and the keys must be returned on the newly agreed check-out date. We accept no liability for any loss, damage, or expense incurred, and we cannot guarantee reimbursement for any costs associated with such changes.

Additionally, if keys are not returned upon check-out, we reserve the right to charge the guest for the replacement of locks, keys, building fobs, and car park fobs.

5. Facilities & Services

Please note that no items may be removed from the apartments or dismantled in any way. Furniture must not be taken out of the apartment.

6. Entry & Inspection

VELAYAT reserves the right to enter the property at reasonable times and with appropriate advance notice for the purpose of inspecting the premises or showing the property to prospective buyers, renters, or other authorised individuals. In cases where a Rental Agent believes there is an imminent danger to any person or property, they may enter the property without prior notice.

7. Services

VELAYAT cannot be held responsible for any failure or interruption of services within or outside the apartment or the development building. This includes utilities, appliances, and communications such as washing machines, tumble dryers, dishwashers, televisions, broadband, Wi-Fi, electricity, water, and heating. We are also not liable for inconveniences caused by noise, access issues, or service disruptions resulting from engineering or repair work in the property or adjacent areas.

In the event of a service interruption, we will make all reasonable efforts to rectify the issue promptly upon receiving notification. Please note that facilities and services in common areas of the building (e.g., lifts, door systems) are the responsibility of the building managers, not VELAYAT.

We reserve the right to add or remove any services without prior notice. While we strive to have each apartment cleaned and prepared for new guests by check-in time, delays may occur due to staff shortages. In such cases, guests will be granted access to the apartment at check-in time, and cleaning will be completed as soon as possible. No compensation will be offered for any inconvenience.

Broadband
Wireless broadband (Wi-Fi) is available in all apartments free of charge. While we make every effort to maintain connectivity, we cannot guarantee a consistent connection at all times. We will provide support and maintenance for any hardware faults (e.g., wireless routers). However, if the fault lies with the guest's devices, support will not be available. If the broadband key or fob is lost, taken, or not returned upon checkout, a charge of £100 will be incurred for replacement.

Extra Beds
A travel cot can be provided for an additional cost (to be agreed upon at the time of booking) and must be reserved at least 48 hours prior to arrival. We cannot guarantee availability on short notice, and cots will only be delivered during office hours (9 AM to 6 PM, Monday to Friday). Cots are available for infants aged 12 months and under, and guests must supply their own bedding, pillow, and duvet for the cot.

Extra Linen

Linen will be provided once or twice a month. Additional bed linen can be supplied at a cost of £25.00 per set, and extra towels are available for £15.00 per set. Requests for extra linen must be made during office hours (9 AM to 6 PM, Monday to Friday) and will be delivered only during these hours.

Maid Service

For stays of two weeks or longer, a weekly maid service is available for an additional charge. This service includes cleaning the apartment and refreshing the bed linen and towels.

Emergency Call-Outs

An emergency contact number is provided for guests to reach a maintenance manager directly. This number is strictly for emergencies, such as power cuts or lost keys. A call-out fee of £150 will be charged for these services. For critical emergencies like floods or fires, a call-out fee of £250 will apply.

Luggage & Mail Storage

We do not offer storage facilities for luggage or personal belongings, including mail or packages. Under no circumstances can we accept these items. Keys to the apartment's post boxes are not provided; however, post is checked regularly. If requested, mail can be delivered to the apartment; otherwise, it will be returned. We do not offer mail forwarding services once a guest has checked out.

Hot Tub Service

We provide comprehensive instructions on how to use and maintain the hot tub during your stay. Please note that failure to follow these instructions may result in the full deposit being charged. VELAYAT will not be liable for any unforeseen circumstances arising from non-compliance with the provided rules. Additionally, any damage to or breach of our hot tub policies will result in a full deposit charge. By signing these terms and conditions, you acknowledge and agree to the above terms.

8. Number of Occupants

The guest agrees that no more than the agreed number of occupants shall be permitted on the property at any time during the rental term. All occupants must comply with the conditions and restrictions outlined in this agreement.

The maximum number of guests allowed in each property is limited to the number of beds available at the time of booking. Any additional guests who enter the property and were not included in the original booking will be considered part of a party or gathering. In such cases, the full deposit will be charged, and the stay will be terminated immediately.

Unauthorised guests are not permitted to enter the property. For example, if you have booked for four people, no additional guests should be allowed into the property.

VELAYAT reserves the right to charge for any additional guests not mentioned at the time of booking. The apartment may not be re-let or sublet to any other group or party without the written approval of VELAYAT. We reserve the right to refuse entry or terminate the stay of the guest and their party if this condition is breached.

9. Check-in, Check-out & Return of Keys

Check-in is available from 4 PM, and check-out must be completed by 10 AM.

All keys, parking passes, building fobs, and parking permits must be returned no later than 10 AM using the keynest. VELAYAT reserves the right to charge for any late departures after 10 AM.

  • Lost, Damaged, or Non-returned Parking Permits: £250 each

  • Lost, Damaged, or Non-returned Keys: £250 each

  • Lost, Damaged, or Non-returned Electronic Parking Fobs: £250 each

  • Lost, Damaged, or Non-returned Door Sensor Fobs: £250 each

If there is a delay in returning keys, VELAYAT reserves the right to charge for an additional night's stay for each day the keys are not returned. For long-term bookings, charges will continue until the end of the next payment cycle.

A fine of £250 will be applied if a parking permit is not returned by 10 AM on the day of departure. Similarly, if keys are not returned, we reserve the right to charge for the replacement of locks, keys, building fobs, and car park fobs.

In the event of a late check-out or refusal to vacate the apartment by the scheduled check-out time, we reserve the right to remove all persons and belongings from the apartment.

10. Damages to Apartment & Payment of Additional Charges

At the time of booking, you must provide valid credit or debit card details. These card details will be used to charge for any damages incurred during your stay. We reserve the right to charge your card without prior notice for any amounts due under these terms.

The apartment should be left in a reasonable condition upon your departure. If we determine that additional specialized cleaning is necessary (such as carpet cleaning to remove stains), an additional fee of up to £250 may be applied. For bookings longer than 28 days, a discretionary final cleaning charge of up to £250 may also be incurred. If the property is deemed unfit for occupancy, you will be responsible for compensation due to loss of revenue, in addition to the costs of cleaning and repairs. Any stains on linens that cannot be removed will be charged to your deposit. We reserve the right to charge £250 for specialized cleaning if the property is left in exceptionally poor condition or if smoking is detected in the apartment.

Damages

You are fully responsible for covering the costs of any damages to the apartment or its contents. If any breakages or damages are found during your stay or after you vacate, we will notify you by email or phone within 10 days, providing a detailed report of the damages and, where applicable, the associated costs for repair or replacement. Photographic evidence will be provided when possible. It is your responsibility to inspect all items and ensure there is no damage. Condition reports can be supplied at both the beginning and end of your stay upon request.

This agreement does not limit or exclude our liability for death or personal injury resulting from our negligence, nor for any damage arising from fraud or fraudulent misrepresentation. Subject to the above, we are not liable for any loss of profits, business interruption, depletion of goodwill, anticipated savings, goods, contracts, use, data corruption, or any special, indirect, consequential, or economic losses.

If you are booking on behalf of a business or an employee, that business agrees to indemnify us against all liabilities, costs, expenses, damages, and losses (including any direct or indirect losses, loss of profits, reputation, and legal costs) arising from your or your business's breach or negligent performance of these terms.

If you are booking for a business, our total liability regarding your booking—whether in contract, tort (including negligence), misrepresentation, or otherwise—will be limited to the amount paid for your booking. We are not liable for any failure or delay in performing our obligations due to circumstances beyond our control, including, but not limited to, acts of God, hostilities, riots, civil disturbances, acts of terrorism, government actions, fires, floods, severe weather, utility outages, renovations, strikes, lockouts, or embargoes. Except in cases of death or personal injury caused by our negligence, or any liability that cannot be excluded by law, our liability to you will be limited to the higher of (i) £1,000 or (ii) the value of the booking.

Car Parking

Each property includes one free parking space, if indicated at the time of booking. The parking space will be available from 4 PM on the day of your arrival and must be vacated by 10 AM on the day of your departure unless otherwise agreed in writing with VELAYAT.

CCTV at Entrance

We have CCTV cameras installed to monitor the entrances and exits of our properties. This is to protect against unauthorized access, parties, and illegal activities, as well as to ensure your safety. Tampering with, adjusting, or covering the CCTV cameras may result in immediate eviction and the forfeiture of your deposit.

11. Liability

The Guest acknowledges that all personal property, furnishings, personal effects, and other items brought into the Property by the Guest or their permitted guests and visitors are at the Guest's own risk concerning theft, damage, destruction, or any other loss. The Rental Agent shall not be liable for any such incidents.

The Guest agrees to indemnify and hold harmless the Rental Agent, along with their agents, owners, successors, employees, and contractors, from any costs, damages, liabilities, claims, legal fees, or other actions arising from any damages, costs, or attorney's fees incurred by the Guest, permitted guests, visitors, or representatives. This includes claims related to property destruction, personal injury, or loss of life sustained by the Guest or their family and visitors on or near the Property.

We cannot be held liable for any theft or damage to your personal belongings during your stay. It is strongly advised that you have appropriate insurance coverage in place. All warranties, conditions, and other terms implied by statute or common law are, to the fullest extent permitted by law, excluded from any contract with us and will be replaced by these conditions.

We regret that we cannot accept liability for any loss, damage, or additional expenses incurred due to alterations or cancellations of bookings, or our inability to fulfill our contractual obligations as a result of events classified as ‘force majeure.’ In these Booking Conditions, ‘force majeure’ refers to any event that could not have been reasonably foreseen or whose consequences could not have been reasonably avoided, even with all due care. Such events may include war or threats of war, civil disturbances, terrorist activities, industrial disputes, natural or man-made disasters, fires, adverse weather conditions, and similar events beyond our control or that of the relevant service providers. Nothing in these terms shall affect your statutory rights as a consumer.

Any items left in an apartment after the agreed departure time are at the owner's risk. We accept no responsibility for these items and reserve the right to remove them; safekeeping is not guaranteed.

Lost property can be returned to you at your expense upon prior agreement, but VELAYAT will not accept liability for any items that go missing.

Each guest is provided with one set of keys (and fobs, etc.). A second set can be arranged at the time of booking or, if requested after check-in, will be subject to management’s discretion and availability.

12. Law & Jurisdiction

These terms and conditions, along with all matters arising from them, are governed by the laws of England and Wales. In the event of any dispute, the client agrees to submit to the exclusive jurisdiction of the courts of England and Wales.

13. Termination by VELAYAT

VELAYAT reserves the right to terminate a booking at any time for reasons including but not limited to partying, playing loud music, causing general nuisance, abusing staff or other guests, mistreating the apartment, nonpayment, or engaging in criminal activity by occupants or their guests. In such cases, VELAYAT is not obligated to provide alternative accommodation. The notice period for termination is at the discretion of VELAYAT.

14. Injury or Loss

VELAYAT cannot be held liable for any personal injuries sustained by guests while in our apartments, nor for any loss or damage to personal belongings, regardless of the circumstances. Neither VELAYAT nor its representatives are responsible for events beyond our control, including mechanical breakdowns, illness, or failures in public service supplies.

15. Rights of Access

Representatives of VELAYAT or their subcontractors have the right to access the property at any time, with due consideration for the hirer's convenience, for the purposes of inspecting the property and performing any necessary repairs or maintenance.

16. Pets

Unfortunately, no pets of any kind are allowed under any circumstances. The client is responsible for any violation of this policy. VELAYAT Management reserves the right to terminate your stay if it is determined that this rule has been breached. In such cases, no refunds will be issued, and a surcharge of £250 will apply if evidence of pets is found in the apartment.

17. Smoking

Smoking is strictly prohibited in the apartments and in the internal communal areas of the apartment blocks. Smoking is only allowed on external balconies associated with the apartment. A surcharge of £250 will be charged if any evidence of smoking is found in the apartment.

18. Complaints

While we strive for customer satisfaction, if you are not fully satisfied with the service provided, please notify our office within 24 hours of the issue by emailing VELAYAT at RS@Velayat.com. We will take reasonable steps to resolve the issue. VELAYAT is not liable for complaints submitted after this 24-hour period.

19. Information

All information provided by VELAYAT is given in good faith and is based on the information available at the time. While we take reasonable measures to ensure accuracy, VELAYAT is not liable for any discrepancies, however caused. We reserve the right to add or remove services or facilities without prior notice.

20. Interest

Interest on overdue invoices will accrue from the date payment is due, on a daily basis, at a rate of 4% above the NatWest Bank base rate in effect at that time. This interest will continue to accrue until payment is received, including after any judgment.

21. Security of Tenure

All properties are provided as serviced accommodations, which means no tenancy rights are established. Consequently, these accommodations are exempt from the security of tenure provisions under the Rent Act. VELAYAT retains the right to access the apartment or terminate your stay at any time without prior notice if deemed necessary.

22. Usage and Nuisance Behaviour

The properties are strictly for residential use only and must not be utilised for parties, loud music, or any form of nuisance behaviour. Guests are expected to be considerate of other residents in the building. If VELAYAT Management determines that disruptive behaviour has occurred, your stay may be terminated without a refund, and an additional fee of £250 will be applied. Moreover, if extra cleaning is required due to such behaviour, a charge of £150 will be incurred.

As a guest, you agree to maintain the property in a clean and sanitary condition, using it responsibly to avoid damage or loss. You and any permitted guests must avoid loud noises and refrain from disturbing neighbours. The property must not be used for immoral, offensive, or illegal activities, nor should any laws, association rules, or ordinances be violated, or any nuisance created on or around the property.

Occupancy in each apartment is limited to the number of beds available. In some cases, extra beds can be arranged for an additional charge, which must be agreed upon at the time of booking.

Group and Special Occasion Bookings

VELAYAT does not knowingly accept bookings for hen/stag parties or similar group gatherings. Should a group booking be permitted, guests must provide a reason for their stay. If it is discovered that parties are being held, the guests will be evicted immediately without refund, and a fee of £250 will be charged.

Any behaviour considered inappropriate or illegal by VELAYAT Management will result in immediate eviction of all guests without a refund, and, if necessary, the situation will be reported to West Midlands Police for further investigation.

If you fail to comply with the terms and conditions of this agreement, you must vacate the property, remove all personal belongings, and leave the premises in good condition without any damage. No part of the rental fee will be refunded, and should legal action be required, the prevailing party is entitled to recover all incurred costs from the other party.

Assignment or Sublease

Guests are not permitted to assign or sublease the property or allow any individuals who are not family members or registered guests to use any part of the property as outlined in this agreement.

23. Property Specifications

We take reasonable care to ensure that the information presented on our website and other promotional materials is accurate; however, this information is subject to change without prior notice. All content is provided in good faith, and we do not guarantee that descriptions of our apartments are completely accurate or exhaustive. Please note the following regarding our properties:

  • Unique Properties: Each apartment features its own distinct style, size, and layout, leading to variations in furnishings. While we confirm your accommodation and location in advance, we cannot guarantee the exact apartment prior to your arrival, as changes may occur at any time.

  • Apartment Layouts: Any floor plans included on our website serve as general representations of the accommodations. Actual dimensions, designs, fixtures, furnishings, and amenities may differ from those shown in the plans. VELAYAT reserves the right to modify or remove services and facilities without prior notice.

  • Occupancy Limits: The maximum number of occupants per apartment is limited to the number of beds available. Additional beds may be arranged for an extra fee, subject to prior agreement at the time of booking. Should the number of occupants exceed the specified limit, we may deny access to the apartment and reserve the right to charge for additional accommodations.

  • Adherence to Policies: You and your guests are required to comply with any rules and regulations set forth by us. We encourage you to familiarise yourself with the safety protocols in the apartments, the building, and the local area, particularly concerning fire evacuation and security measures.

  • Financial Responsibilities: You and your party are responsible for the payment of the rental fee, any charges associated with the use of facilities (such as additional laundry services), and any other fees imposed by us for the use of amenities.

  • Internet Use: If internet or broadband services are available, you agree to use these responsibly and for lawful purposes only.

24. Discount and Promotional Codes

All promotional codes issued by VELAYAT via web, email, print, or phone are subject to change, expiration, or refusal at any time. VELAYAT reserves the right to modify or withdraw promotional offers without notice. Valid promotions and discounts must be applied at the time of booking to be reflected in the total cost before payment is made. This ensures clients can verify the successful application of any promotions. Discounts or promotional codes cannot be applied to reservations made over the phone or after the booking has been completed.

25. Included as Standard

VELAYAT typically provides complimentary toiletries and condiments upon arrival at its discretion. Please note that these items will not be replenished during your stay, and it is not VELAYAT’s responsibility to provide additional supplies.

As a standard practice, VELAYAT may offer the following items upon arrival (although there is no obligation to do so): a sample of washing-up liquid, one toilet roll, one dishwasher tablet, one cleaning cloth, one bin bag, a selection of toiletries, and complimentary condiments.

Store Cupboards: Please be aware that store cupboards are for staff use only. Any items removed from these cupboards will incur a charge based on the individual cost of each item. Inventory checks are conducted after each visit.

26. Acceptance of Terms and Conditions / Contract of Hire

All bookings are subject to these terms and conditions, which are considered fully accepted by the guest and all members of their party. Payment of the deposit and/or apartment fee signifies acceptance of these terms.

General Provisions

This Agreement constitutes the complete understanding between the parties regarding the rental of the property. Any changes, amendments, or modifications must be made in writing and signed by both the Guest and the Rental Agent to be valid. This Agreement shall be governed by the laws of the United Kingdom. The terms "Rental Agent" and "Guest" include their respective heirs, successors, and representatives. The failure or waiver of either party to enforce any provision of this Agreement shall not be construed as a waiver of that or any other provision in future breaches. If any provision is deemed invalid, the remainder of the Agreement shall remain in effect.

Any notice required under this Agreement must be provided in writing and sent to the contact information specified herein. This Agreement may be executed in one or more counterparts, each of which shall be considered an original, collectively constituting one instrument.

A digital signature shall be regarded as a valid signature.
